7086Arthur F. Willmarth Mortgage to Stephen B. Brown. Arthur F Willmarth of Adams, Berkshire Co, MA in consideration of $15,540.55 paid by Stephen B. Brown of Adams aforesaid, the receipt whereof I do hereby acknowledge do hereby give, grant, sell and convey unto the said Stephen B. Brown & his heirs & assigns forever, one undivided third part of the following described real estate situate in the Towns of Adams & Clarksburgh & being the same this day deeded to me by Stephen B. Brown & also one undivided third part of the personal property named in said Deed to me & for a more particular description of said premises & property reference to be had to said deed from said Brown to me. … Provided nevertheless that if the said Arthur F. Willmarth or his heirs, executors or administrators pay to the said Brown or his heirs Executors Administrators or assigns the sum of $15,540.55 & interest on the same as follows viz - $3,108.11 in one year from date hereof & interest & $3,108.11 in two years from date & interest & $3108.11 in three years from date & interest & $3108.11 in four years from date & interest & $3,108.11 in five years from date & interest - Then this deed as also five certain promissory notes bearing even date with these presents given by the said Willmarth to the said Brown to pay the same sums at the times aforesaid shall be void - otherwise shall remain in full force. 2 May 1842 /s/ Arthur F. Brayton of said Adams Esquire to be assignees of the Estates of said Brown, Harris & Co. & of the joint and separate estates. … use and benefit of all the Creditors of said Brown, Harris & Co. & the several creditors of said Stephen B. 7086William C. Plunkett et al. Assignees To Edward G. Loring. Assignees of the Estate of Stephen B. Brown, Elisha Harris, & Arthur F. Willmarth, Manufacturers & co-partners in trade under the firm & style of Brown, Harris & Company in said North Adams & of the separate estate of each of said partners insolvent debtors … Whereas, Henry B. Willmarth of the City of New York in the state of New York has transferred & released to the said Plunkett & Brayton assignees as aforesaid all his right title & interest in the said mortgages, notes & sums of Money. Whereas, We the said Plunkett & Brayton as assignees as aforesaid in consideration of $2502 to us paid by Francis Skinner of the City of Boston & Edwin Hoyt of the said City of New York, Merchants, the receipt whereof we hereby acknowledge, have agreed to sell & convey the Print Works in North Adams, so called, subject to the mortgages & the notes therewith given & the sums of money thereon due to Edward G. Loring of said City of Boston, Counsellor at Law, upon the trusts herein after declared & for the sake of maintaining the title of said mortgages & preventing any mergers thereof. … Skinner & Hoyt, hereby, transfer assign & convey to said Loring two certain mortgages described as follows, viz, One Mortgage made by Elisha Harris to Stephen B. Brown to secure the repayment of $12,467 dated 11 Nov 1840. & recorded with Deeds of said County of Berkshire Liber 52 Folio 291. A certain other mortgage made by Arthur F. Willmarth to said Stephen B. Brown to secure the repayment of $15540 dated 2 May 1842 & recorded with deeds of said county of Berkshire together with the notes with the said two mortgages given & not taken up & the sums of money remaining due thereon - meaning hereby to convey all am right title and interest in & to said mortgages & said notes & said sums money & the lands & property described in the Deeds of said Mortgages - by virtue thereof - as assignees of said Estate of Brown Harris & Company, or of the separate Estate of either & each of said partners as assigns of said Henry B. Hall, a Master in Chancery in Berkshire Co by virtue of the authority in him vested by his Deed of Assignment conveyed and assigned to the said Plunkett & Brayton as assignees as aforesaid all the real & personal Estate of the said Brown, Harris & Company, as well as the separate estate of each of said partners, … Know Ye that we the said Plunkett & Brayton assignees as aforesaid in consideration of $2502 to us paid by Francis Skinner of the City of Boston & Edwin Hoyt of the City and State of New York, Merchants, the receipt whereof is hereby acknowledged to hereby grant, sell and convey assign & transfer to the said Skinner & Hoyt the following described real & personal estate, viz. the real estate known as the Print Works property situated in said Adams & bounded as follows … near the East line of a lot of land deeded to Brown & Tyler by William Bradford on 10 Apr 1836 … It being declared & agreed that said conveyance of real & personal property is made subject to the two mortgages viz. a Mortgage made by Elisha Harris to said dS. B. Brown of one third of said premises to secure the sum of $12,467 & dated 11 Nov 1840 & recorded with Deeds of Berkshire Co Lib 52 F 291 & a mortgage made by Arthur F. Willmarth of one third of said premises to secure the sum of $15,540 dtd 2 May 1842 & recorded with deeds of Berkshire County Lib 40 F 552 both of which mortgages previous to the ensealment & delivery hereof have been by us the said Plunkett & Brayton as assignees as aforesaid conveyed to Edward G.
